The Cage Training LLC Liability Waiver and Release of Claims 

1. Acknowledgment of Risk 

I understand and acknowledge that participation in activities at The Cage Training LLC—including but not limited to softball and baseball training, joy private lessons, use of batting cages, pitching areas, workout equipment, strength and conditioning activities, and participation in any other athletic programs—entails inherent risks. These risks include, but are not limited to: injukkooiries from being struck by balls, bats, or other participants; sprains, strains, fractures, or other musculoskeletal injuries; equipment malfunction or improper use; slip, trip, and fall hazards; risks associated with exercising alone; serious injury, illness, or even death. I voluntarily assume all risks associated with participation and use of the Facility, whether caused by negligence of The Cage Training LLC, its owners, staff, or other participants. 

2. Release of Liability and Indemnification 

In consideration for being permitted to use The Cage and participate in its programs, I, on behalf of myself (and/or my minor child), release, waive, discharge, and hold harmless The Cage Training LLC, its owners, officers, employees, trainers, contractors, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained while participating in Facility activities or while on the premises. I further agree to indemnify and defend The Cage Training LLC and its representatives from any claims brought as a result of my (or my minor child’s) actions, conduct, or negligence. 

3. Health and Medical Condition 

I certify that I (or my child) am physically fit to participate in activities at The Cage Training LLC and have not been advised otherwise by a qualified medical professional. I understand that it is my responsibility to inform The Cage Training LLC of any medical conditions that may affect participation. I authorize Facility staff or representatives to obtain emergency medical care on my behalf if deemed necessary and assume full financial responsibility for any medical treatment obtained. 

4. Facility Rules

I agree to abide by all Facility rules and policies, including: no unauthorized guests during non-staffed hours; proper and safe use of all equipment and training areas; and immediate reporting of any equipment issues, injuries, or unsafe conditions. I understand that access may be unsupervised and that I am solely responsible for my own safety during all staffed or unstaffed hours.

5. Personal Property 

I understand that The Cage Training LLC is not responsible for any lost, stolen, or damaged personal property, whether stored in lockers, vehicles, or elsewhere on the premises. 

6. Photography and Media Release 

I grant permission for The Cage Training LLC to take photographs or videos during training sessions or events and to use them for promotional purposes, unless I provide written notice declining consent. 

7. Membership and Lesson Agreement 

I acknowledge that membership fees, lesson fees, or program payments are non-refundable, except where prohibited by law or explicitly stated in the membership agreement. I acknowledge and agree to the following terms regarding lessons, packages, and memberships:

• Payment Policy: All lesson purchases and lesson packages must be paid in full at the time the first booking is confirmed. No session time will be held or guaranteed without full payment.
  
  

• No Refund Policy: All payments for lessons, packages, and programs are non-refundable, except where prohibited by law or explicitly stated in writing by The Cage Training LLC.
  
  

• 24-Hour Cancellation Policy: A minimum of 24 hours’ notice is required to cancel or reschedule any lesson. Any lesson canceled with less than 24 hours’ notice will be forfeited and will not be refunded or credited back to a lesson package.

8. Governing Law and Severability 

This agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin. If any portion of this agreement is found to be invalid, the remaining provisions shall continue in full force and effect. 

9. Acknowledgment and Signature 

I have read this waiver, fully understand its terms, and voluntarily agree to its conditions. I understand that by signing this document, I am waiving certain legal rights, including the right to sue The Cage Training LLC and its representatives for negligence.
